Version 2026-09-21. This is what you agree to at checkout.
This agreement is between Digital Film Marketing Inc. (“DFM”) and the business named at checkout (“Advertiser”). It takes effect when Advertiser signs at checkout and the first payment clears.
DFM will play Advertiser's ad on the screen listed on the order page. The order page sets the screen, address, spot length, loop position, hours on air and monthly fee. Those details are part of this agreement.
The term is month to month unless the order page states a different term. It starts the day the ad first airs and renews automatically each month until either side cancels under Section 10. If the order page states a fixed term, such as 3, 6 or 12 months, that term controls and the agreement continues month to month after it ends.
Advertiser pays the monthly fee shown on the order page, in advance, by the payment method given at checkout. Payments are processed by Stripe. Advertiser authorizes DFM to charge that method each month until cancellation.
A promotional rate stays in place for the term on the order page. After that, DFM may change the rate with 30 days' written notice, and Advertiser may cancel before the new rate starts.
If a payment fails, DFM may pause the ad until it is paid. If it stays unpaid for 10 days, DFM may end the agreement.
The ad goes live within 3 business days after DFM approves the artwork. The first billing month starts on the day the ad first airs, not the day of checkout. If Advertiser has not supplied artwork within 14 days of checkout, the billing month starts on day 15.
Advertiser supplies the ad in the format and size DFM specifies, or asks DFM to build it from Advertiser's logo, photos and copy. The screen has no sound. Advertiser may swap the artwork up to twice a month at no charge. Every new version goes through the same review.
DFM does not air ads that contain or promote:
DFM may update this policy. Changes apply to new artwork and to renewals, not to a month already paid for.
DFM reviews every ad before it airs and may decline or take down any ad that violates the Content Policy.
If DFM declines an ad, DFM tells Advertiser why within 2 business days. Advertiser then has 7 days to supply a compliant replacement. If Advertiser does not, or tells DFM it will not, DFM cancels the order and refunds in full any amount paid for time that did not air. The refund goes back to the original payment method within 10 business days.
If an ad that was already airing is taken down for a policy violation, DFM refunds the unused part of that month on a daily pro rata basis.
No refund is owed for days an ad actually aired. Approval by DFM is not legal advice and does not shift responsibility for the ad's content away from Advertiser.
DFM gives Advertiser proof that the ad ran. Within 5 business days after the ad first airs, DFM sends a dated photo or video of the ad playing on the screen. Each month DFM sends a playback report from the screen's media player showing the number of plays and total time on air. Advertiser may ask for a fresh photo or video once a month.
Impression figures come from Geopath, a third-party audience measurement service. They are estimates of how many people have the opportunity to see the screen. DFM does not guarantee impressions, foot traffic, sales or any other result.
Screens go down sometimes for power, internet, weather, maintenance or reasons at the host location. If Advertiser's ad is off air for more than 48 hours in total during a billing month, DFM credits the lost time to the next month or extends the run by the same amount, at DFM's choice. If the screen is removed or stays off for more than 14 days in a row, either side may cancel and DFM refunds the unused part of the month. These credits and refunds are Advertiser's only remedy for downtime.
Advertiser may cancel at any time by emailing ahad@digitalfilmmarketing.com or using the link in the billing receipt. Cancellation takes effect at the end of the billing month already paid for. The ad keeps running until then, and that month is not refunded.
DFM may cancel at any time with 7 days' notice and refunds any paid time that does not air. DFM may cancel immediately for non-payment or a Content Policy violation.
Advertiser confirms that it owns or has permission to use everything in the ad, that the ad is truthful and legal, and that it holds any license needed to advertise its product or service. Advertiser gives DFM a license to display the ad on the screen for the term. DFM may use photos and video of the screen with the ad playing for proof of play and in DFM's own marketing, unless Advertiser opts out in writing.
Advertiser will cover DFM and the host location for any claim, fine or cost that arises from the content of the ad or from Advertiser's products or services.
DFM's total liability under this agreement is limited to the fees Advertiser paid in the 3 months before the claim. Neither side is liable for lost profits or indirect damages.
California law governs this agreement. Notices go by email to the addresses given at checkout. Advertiser may not resell or transfer its spot without DFM's written consent. This agreement and the order page are the whole deal between the parties, and changes must be in writing. Electronic signatures and records are valid and binding.
